The Organizational Setting

Under the direction of Director of the Capacity Development and Implementation Bureau (CDI), the Field Operations Section (FOS) is responsible for the development, implementation, monitoring, evaluation, and closure of Technical Assistance (TA) and Technical Cooperation (TC) projects. It drafts agreements and aids in creating country-specific and regional projects and programs by identifying priority areas, developing objectives, activities, and deliverables, setting timelines, and specifying budgetary requirements.ย 

Additionally, under the direction of the CDI Director, the Field Personnel Section (FOS/FRU) recruits international experts to implement Capacity Development and Implementation projects across various Civil Aviation fields and manages the ICAO Roster of Experts.

Major duties and Responsibilities Function 1 (incl. Expected results)

Participate in the project, under the guidance of the Project Coordinator (ICAO PC) to carry out the following functions and achieve the respective expected results.

Perform a thorough review of the State current situation of PQs and CAPs related to LEG and ORG areas, and provide necessary assistance as follows:ย 

  • Review reports of previous missions conducted, including ICAO Regional Office and COSCAPs. Review all PQs related to LEG and ORG areas to help identify the scope of work to be completed.ย 
  • Review the corrective actions already taken based on the CAPs and identify yet not-satisfactory PQs.ย 
  • Provide consultancy, direction, advice and consistence guidance to correct yet not-satisfactory PQs.ย 
  • Monitor progress of implementation of CAPs for not-satisfactory PQs, and assist national counterpart staff by providing further guidance.ย 
  • Provide advice and guidance to national counterparts to regularly update the LEG and ORG CAPs onto the CMA Online Framework (OLF), including Self-Assessment.ย 
  • Assist PC to raise awareness to the State technical staff and AIG investigators on the general understanding of the USOAP โ€“ CMA programme and all related matters, including the CMA Online Framework (OLF).ย 

    Deliverable(s):

  • Report on Corrective Action Plan. Function 2 (incl. Expected results)

    Provide consultation, direction and advice to appropriate national authorities for clear separation of functions between regulator and service provider for AIS, Cartography (CHART), PANS OPS, MET and SAR and AIG independence from. the State in charge of conducting aircraft accident and incident investigations, including recommendations on legislative provisions for identified shortcomings in the primary legislation, by:ย 

  • Reviewing the present regulatory and service provider arrangements for ATS, AIS, Cartography (CHART), PANS OPS; MET and SAR.ย 
Reviewing the present organizational structure in discharging AIG investigations.ย  Identifying the conflicts/discrepancies in the current organizational structure to ensure the clear separation between the regulator and service provider functions, as well as the independent AIG investigations.ย  Consultations with ICAO ANS Expert to draft necessary legislation to resolve the conflicts/discrepancies through due legislative process.ย  Drafting, in coordination with ICAO ANS Expert, necessary primary legislation as well as relevant regulations for the separation of service provider and regulatory functions, ensuring that it contains all necessary provisions identified and in particular, penalties, empowerment of regulators for ANS oversight.ย  Drafting, in coordination with ICAO AIG Expert, primary legislation and operating regulations for the independent AIG investigations, with putting all necessary provisions in place.ย  Submitting draft primary legislation and regulations for ANS and AIG for approval for timely promulgation.ย 

Deliverable(s):ย 

Report with proposed amendment to primary legislation for separation of regulatory functions and service provider function.ย  Report with proposed primary legislation for the independent AIG investigations.ย  Report with proposed ANS and AIG regulations for approval and promulgation Function . Provide guidance and advice on the following, as may be appropriate and practicable within the timeframe of the project:ย 

a) National rule making process, by:ย 

Advice on establishing an effective rulemaking process covering regulations, directives and circulars and their amendment procedures, including guidance for its effective implementation, and ensuring a quality control over the dissemination of legislative information to the public.ย  Advice on establishing a comprehensive enforcement policy, including guidance for its effective implementation.ย  Advice on establishing a procedure for notification of differences to ICAO SARPs and publication in the AIP of significant differences from the Stateโ€™s regulations, including guidance for its effective implementation.ย 

b) Training requirements for national counterparts:ย 

Advice on a comprehensive Organizational Training Policy. Advice on a methodology for training record management.ย  Advice on required means to ensure that the designated staff are duly qualified and trained.ย  Advice on required means to ensure that the State has and keeps sufficient technical personnel, meeting appropriate qualification and experience requirements, to effectively carry out its safety oversight functions.ย  Advice on adequate means, including sufficiently attractive employment conditions and appropriate recruitment processes, to enable the State to attract, recruit and retain qualified and experienced technical staffย

Report with summary of assistance actions provided. Function 4 (incl. Expected results)

Maintain co-ordination with the ICAO PC and assist the PC as necessary to achieve objectives of the project in the matter of:ย 

Maintaining a smooth communication channel with the PC, in regards to daily activities and any developments/risks that the PC should know, and seeking advice as necessary.ย  Work plan for the project and national counterparts assigned to the project.ย  Preparing monthly Project Progress Reports (PPRs) and Project Terminal Report (PTR).ย  Prompt response to correspondence received, related to project activities.ย  Participation in project review meetings.ย 

Deliverable(s):ย 

Assistance for the successful completion of the project.ย  LEG/ORG portion of the PPRs and PTR. Function 5 (incl. Expected results)

Qualifications and Experience Education

University degree in law with specialization and advanced qualifications in air law.

Essential

Minimum 10 yearsโ€™ experience in application of Air Law and at least 5 yearsโ€™ experience at drafting aviation law. . Experience, preferably at a senior position in a national civil aviation organization legal department or similar aviation-related organization.ย  Experience in formulation of civil aviation policy of a State.ย  Experience in the drafting of basic aviation legislation of a State.ย  Experience in preparation of organizational structures, operating regulations, procedure documents and position training plans.ย  Experience in devising an action plan with work steps and timelines for proper structuring of a civil aviation regulatory organization.ย  Thorough knowledge in relevant ICAO SARPs and guidance documents related to the establishment of a civil aviation organization, including separation of air navigation services, aerodrome operations from civil aviation regulator as well as establishment of an independent accident investigation organization.ย  Completion of ICAO USOAP CMA Competency-based Training (CBT) in LEG/ORG area. Essentialย 

A good command of oral and written English.

Desirableย
