Background:
The OSCE within its second dimension on environmental and economic issues assists the governments of participating States in strengthening their national practices of good governance and combating corruption, advising on improving the relevant institutional framework and building up national capacities. The OSCE participating States have recognized โthat good governance at all levels is fundamental to economic growth, political stability, and security. Good public and corporate governance, rule of law and strong institutions are essential foundations for a sound economy, which can enable our States to reduce poverty and inequality, to increase social integration and opportunities for all, to attract investment and to protect the environment.โ (see Declaration of the Ministerial Council MC.DOC/2/12 of December 7, 2012). On the basis of its mandate, the OSCE Programme Office in Dushanbe (โOSCE POiDโ hereafter) supports efforts aiming at decreasing related risks and further strengthening capacities for good governance and combating corruption.
State-owned enterprises (SOEs) in Tajikistan dominate and have significant influence on the performance of most sectors in the economy including natural resources, energy, manufacturing, telecommunications and transport. The SOE sector has been the key driver of Tajikistanโs industrial development during the past decades and will likely remain so in the near future. In this respect, improvements in the governance standards and practices of SOEs and increasing their efficiency and financial resilience will ensure their further sustainable contribution to Tajikistanโs economic development. In the industrial sector of Tajikistanโs economy, the Ministry of Industry and New Technologies of the Republic of Tajikistan (โthe Ministryโ hereafter) carries out monitoring, governance, financial supervision and strategic guidance of key SOEs.
It is of vital importance for the Republic of Tajikistan to strengthen competition in the economy and thus introduce modern standards and practices of corporate governance in SOEs to increase their efficiency and improve the operations. In 2021, the OSCE POiD supported the Ministry by having contracted a national company that conducted a needs assessment to improve the legal and institutional framework for the governance of SOEs. Their analysis โAssessment of measures necessary to improve the legal and institutional framework for the management of state industrial enterprises of the system of the Ministry of Industry and New Technologies of the Republic of Tajikistanโ, including 24 recommendations, was approved by the Ministry in May 2022 and published[1] in June 2022.
To implement 15 selected recommendations from the assessment report, the OSCE POiD commissioned another national company, as a result of a tender procedure, to draft normative-legal documents in 2022. Their work is expected to continue until August 2023. The draft normative-legal documents will be circulated to relevant governmental bodies and institutions for comments and suggestions. In this context, the aforementioned national expert will be responsible for coordinating the proposed amendments, comments and suggestions and for incorporating them into the final drafts of the normative legal documents.
Objective of Assignment:
The OSCE POiD plans to recruit a national expert to coordinate the recommendations proposed and normative-legal documents drafted by the consulting company within MINT and relevant ministries and government agencies for their final approval.
Duration of Assignment:
5 months in the period from August 1 to December 31, 2023.
Tasks and Responsibilities:
The consultant, under the overall supervision of the Good Governance Officer at OSCE POiD and under guidance of the Ministry, will perform the following tasks:
Note: The national consultant will work remotely and will have regular meetings with the Ministry, OSCE POiD, key government stakeholders.

Necessary Qualifications:
Advanced university degree in law, economics, public administration, public management or a related field; 3-5 years of professional experience in the public or private sector; Previous experience in working with government entities; Professional experience of work in or with state-owned enterprises, of corporate governance, and project management is an advantage; Experience in drafting normative-legal acts and legal documents on company law is an advantage; Excellent analytical, writing, organizational, communication, negotiating and team working skills; Excellent skills in written and spoken Tajik, good knowledge of Russian or English; Computer literate with practical experience using Microsoft applications; Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities. Ability and willingness to work as a member of team, with people of different cultural, and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity.
Remuneration Package:
Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
