Standard Job DescriptionSenior Protection Associate Organizational Setting and Work Relationships The Senior Protection Associate reports to the Protection Officer or the Senior Protection Officer. The position may entail supervisory responsibilities for protection staff including community services, registration, resettlement and education depending on the structure of the Office. The incumbent monitors protection standards, operational procedures and practices in protection delivery in line with international standards and provides functional protection support to information management and programme staff. The Senior Protection Associate is expected to coordinate quality, timely and effective protection responses to the needs of populations of concern (PoC) and identify opportunities to mainstream protection methodologies and integrate protection safeguards in operational responses in all sectors. The incumbent contributes to designing a comprehensive protection strategy and represents the Office externally on protection doctrine and policy as guided by the supervisor. S/he also ensures that PoC are involved in making decisions that affect them, whether in accessing their rights or in identifying appropriate solutions to their problems. To achieve this, the incumbent will need to build and maintain effective interfaces with communities of concern, local authorities and protection and assistance partners. All UNHCR staff members are accountable to perform their duties as reflected in their job description. They do so within their delegated authorities, in line with the regulatory framework of UNHCR which includes the UN Charter, UN Staff Regulations and Rules, UNHCR Policies and Administrative Instructions as well as relevant accountability frameworks. Duties - Stay abreast of political, social, economic and cultural developments that have an impact on the protection environment. - Consistently apply International and National Law and applicable UN/UNHCR and IASC policy, standards and codes of conduct. - Assist in providing comments on existing and draft legislation related to PoC. - Provide advice and guidance on protection issues to PoC; liaise with competent authorities to ensure the issuance of personal and other relevant documentation. - Assist in conducting eligibility and status determination for PoC in compliance with UNHCR procedural standards and international protection principles. - Contribute to measures to identify, prevent and reduce statelessness. - Contribute to a country-level child protection plan as part of the protection strategy. - Contribute to a country-level education plan as part of the protection strategy. - Assist the supervisor in implementing and monitoring Standard Operating Procedures (SOPs) for all protection/solutions activities. - Manage individual protection cases including those on GBV and child protection. Monitor, and assist the supervisor with intervening in cases of refoulement, expulsion and other protection incidents. - Assist in identifying durable solutions for the largest possible number of PoC through voluntary repatriation, local integration and where appropriate, resettlement. - Contribute to the design, implementation and evaluation of protection related AGD based programming with implementing and operational partners. - Contribute to and facilitate a programme of results-based advocacy with sectorial and/or cluster partners. - Facilitate effective information management through the provision of disaggregated data on PoC and their problems. - Participate in initiatives to capacitate authorities, relevant institutions and NGOs to strengthen national protection related legislation and procedures. - Assist the supervisor with intervening with authorities on protection issues. - Provide assistance to the supervisor in deciding priorities for reception, interviewing and counselling for groups or individuals. - Assist the supervisor with enforcing compliance of staff and implementing partners with global protection policies and standards of professional integrity in the delivery of protection services. - Assist the supervisor with enforcing compliance with, and integrity of, all protection standard operating procedures. - Recommend and prepare payments to individual cases. - Perform other related duties as required. UNHCR has been present in Hungary since 1989, working closely with state entities including local and municipal authorities, UN agencies, and national partners. UNHCR Multi Country Office in Budapest, Hungary oversees operations in the Czech Republic, Hungary, Slovakia, and Slovenia. Working alongside government counterparts, partners, and national institutions, UNHCR works to ensure refugees and asylum-seekers secure essential rights, access to basic services and legal and protection assistance. UNHCR provides much-needed assistance to refugees across a range of basic needs and protection sectors, while also working to raise awareness and prevention of statelessness.
Since the beginning of the Ukraine Refugee crisis, nearly one-third of the population forced to leave their homes in Ukraine, making it one of the largest human displacement crises today. As of end December 2022, the number of border crossings from Ukraine into Hungary totaled over 3.9 million, with 2 million crossings directly from Ukraine and 1.9 million crossings through the Romanian border. While the vast majority chose to move onward, some 33,200 individuals have registered for temporary protection in Hungary. UNHCR works closely in support of the authorities and in collaboration with partners, to ensure that refugees from Ukraine have access to legal procedures, basic needs, and inclusion opportunities, with a focus on persons with specific needs and vulnerabilities.
The right to seek asylum and protection from refoulement is enshrined in the Fundamental Act of Hungary, and fundamental rules for regulating asylum are laid down in Act LXXX of 2007. However, since 2015 a number of restrictive measures have been introduced, allowing on the one hand to prevent entry, and to remove third-country nationals staying irregularly due to a โ€˜crisis situation caused by mass immigrationโ€™, and on the other hand requiring that asylum-seekers express their intent to seek international protection at the Hungarian embassy in a designated third country, before they are able to access asylum procedures in Hungary. UNHCR is actively engaged in promoting full compliance of asylum legislation with international and EU standards.
Desired Candidate Profile:
The Senior Legal Associate works with the legal team on Hungary-specific issues, under the direct supervision of the Legal Officer, and the overall coordination of the Senior Protection Officer. S/he has a strong legal profile and demonstrated skills in legal research, legal analysis, and legal drafting, as well as in the field of advocacy, training, human rights engagement, and judicial engagement. She will be involved in the drafting of briefing notes and legal documents, including Amicus Curiae and third-party interventions at the national and international level. Moreover, the Senior Legal Associate will ensure constant monitoring and analysis of relevant legislation at national and EU level, with a view to support the officeโ€™s advocacy and recommendations for legislative changes. S/he will support the officeโ€™s training and capacity development activities on legal matters, and will contribute to ensure that asylum-seekers, refugees, and statelessness receive accurate and accessible legal counselling.
Advanced level education in law and previous experience in the field of international and EU refugee law and human rights are essential, as well as excellent drafting and communication skills in English and Hungarian. Experience in the field of asylum and migration, social protection, child protection, gender-based violence, trafficking in human beings, or minority rights would be an asset.
Language Requirement:
Knowledge of English as the UN working language of the duty station and Hungarian language is required.

Remuneration:
In case of appointment, a competitive compensation and benefits package is offered.
G7 Salary range: NET HUF 698,221.75 - HUF 818,297.50

Annual leave: UNHCR staff members holding a temporary appointment will accrue annual leave at the rate of 1.5 working days for each full calendar months of service (i.e. 15 working days per year).

Pension system: Staff members holding a temporary appointment of 364 days will become participants in the United Nations Joint Staff Pension Fund (UNJSPF).

Health insurance plan: locally recruited staff members in Hungary will be enrolled in the Medical Insurance Plan (MIP). The coverage is also optionally available for eligible family members.
