Background:

In 2021 within the structure of the General Prosecutorโ€™s Office (GPO) a new department was established (Department for Supervision of Observance of the Rights of Entrepreneurs and Environmental Laws), which is responsible for the supervision of observance of the rights of entrepreneurs and laws in the sphere of ecology.

The department focuses on protecting business entities from illegal inspections performed by state regulatory and law enforcement agencies, creating and ensuring favorable conditions for environmental protection and conservation, as well as for attracting investments in these sectors.

In connection with the new directions for the GPO, as well as in order to strengthen and ensure the effectiveness of prosecutorial supervision over the implementation of environmental legislation of the Kyrgyz Republic, timely adoption of prosecutorial response measures to identify, prevent and eliminate violations of the law, it is necessary to develop three methodological-practical Manuals:

โ€œProsecutorโ€™s supervision of ensuring the rule of law in specially protected natural areasโ€; โ€œProsecutor's supervision of ensuring the rule of law in the field of subsoil useโ€; โ€œProsecutor's supervision of ensuring the rule of law in the field of production and consumption waste managementโ€

Methodological-practical Manuals will be used as a table book for GPO employees and will enhance their professional capacities of the GPO staff, improve efficiency of their work to conduct high-quality inspections of activities of State and non-state stakeholders.

The OSCE POiB will contract three national consultants for three-month period who will work in close co-ordination with the General Prosecutor's Office of the Kyrgyz Republic to develop three abovementioned methodological-practical Manuals.

Objective of Assignment:

To assist the host country in strengthening of environmental security and good environmental governance by carrying out effective supervision of natural resources use, accounting environmental pollution standards, eliminating misinterpretation and incorrect practice of application of norms of law and normative legal acts, as well as minimizing manifestations of corruption in economic activities of business entities and regulatory authorities.

Tasks and Responsibilities:

Under the supervision of the Programme Manager and in close cooperation with General Prosecutor's Office of the Kyrgyz Republic, the consultants will perform the following tasks:

National Consultant 1 will develop a draft of the methodological-practical Manual โ€œProsecutor's supervision of ensuring the rule of law in the field of production and consumption waste managementโ€:

Conducting of an analysis of the regulatory framework in the field of waste management, determine a list of the most significant violations classified by objects and/or subjects of their commission based on existing reports of law enforcement practice of the prosecution authorities (rating of violations); Developing of a structure draft of the methodological-practical Manual โ€œProsecutor's supervision of ensuring the rule of law in the field of production and consumption waste managementโ€ and discuss it with the General Prosecutor's Office and OSCE POiB; Developing of a draft of the methodological-practical Manual โ€œProsecutor's supervision of ensuring the rule of law in the field of production and consumption waste managementโ€; Conducting working meetings with inspectors of the Ministry of Natural resources, Ecology and Technical Supervision of the Kyrgyz Republic, as well as with experts representing the interests of local communities in the regions most affected by the negative impact of mining enterprises, in order to determine the real situation at mining sites; Participating in working discussions of the methodological-practical Manual draft with the Head of the Department for Supervision of Observance of the Rights of Entrepreneurs and Environmental Laws of the General Prosecutor's Office; Taking part in various events held by the General Prosecutor's Office to highlight the activities for the preparation of the methodological-practical Manual โ€œProsecutor's supervision of ensuring the rule of law in the field of production and consumption waste managementโ€ (if any); In close co-ordination with General Prosecutor's Office preparing and submitting the final versions draft methodological-practical Manual based on the results of discussions and approvals;

National Consultant 2 will develop a draft of the methodological-practical Manual โ€œProsecutorโ€™s supervision of ensuring the rule of law in specially protected natural areasโ€:

Deliverables:

Monthly activity report for the OSCE Programme Office in Bishkek according to the special reporting form, approved by the Prosecutor Generalโ€™s Office of the Kyrgyz Republic; Work plan developed by Consultant in consultation with and agreement of the Prosecutor Generalโ€™s Office of the Kyrgyz Republic outlining expected month by month work with deadlines based on tasks of the Terms of References; Developed one of three methodological-practical Manuals assigned within TOR; Final report on the completed work for the OSCE Programme Office in Bishkek, according to the special reporting form, approved by the Prosecutor Generalโ€™s Office of the Kyrgyz Republic.

Necessary Qualifications:

University degree in Law, Ecology, Public Administration; At least 5 years of experience in analysing the legal framework, summarizing law enforcement practice in the field of environmental protection, and environmental management; Experience in collaborating with international and national experts and institutions; Exposure to environmental issues or nature resource management is desirable; Experience in developing strategic environmental documents; Experience in writing scientific papers would be an asset; Professional fluency in Russian and Kyrgyz with excellent communication (both oral and written) skills; knowledge of English would be an asset; Computer literate with practical experience using Microsoft applications.

Remuneration Package:

Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
