Work LocationHome-based Expected duration22 Dec.25-15 Apri 26 Duties and ResponsibilitiesThe Consultant will be responsible for ensuring that the mock trials He or she will manage the flow of the mock trials Among all activities, the mock trial-related activities will be a simulated trial that will aim to give Judges, Prosecutors and Investigators (tentatively 25/30 in total) a better understanding of: โ€ข The elements of the smuggling of migrants; โ€ข Forms and trends of smuggling of migrants in Algeria, Morocco, and Tunisia; โ€ข Existing legal and institutional framework; โ€ข Intersections between smuggling of migrants and other crimes (e.g. trafficking in person, corruption, money laundering); โ€ข Needs of smuggled migrants, their participation in criminal justice proceedings, protection and assistance measures for the smuggled migrants in the court of law; โ€ข Complex concepts and issues faced by Judges, Prosecutors, and Investigators while analyzing evidence, adjudicating, and sentencing in smuggling of migrants cases. The mock trial activity will be divided into two parts. The first two days will cover a variety of delivery methods (presentations by experts, screening of videos, case studies, group work/discussion) with a focus on substantive topics. In the last three days, UNODC proposes to use the โ€œmock trialโ€ methodology, according to which participants will engage in a case-based simulation that provides them with the best international practice of evidence analysis for ensuring the protection of smuggled migrants and witnesses and the prosecution and sentencing of smugglers. The activity will enhance the capacity of Investigators, Prosecutors, and Judges to effectively prosecute and adjudicate SOM-related crimes by: (1) paying keen attention to the complexities of migrant smuggling, especially the analysis of the available evidence to establish the various elements of the offense while taking into account the concepts within the definition of smuggling of migrants; (2) overseeing the sequence of the mock trials, ensuring that the opening statements, witness examinations, closing arguments, ruling, sentencing and convictions, and any other required elements are followed; (3) promoting cooperation between the participants in the training and fostering a common understanding of the challenges and issues facing the criminal justice system; (4) Supporting the mock trial judges to deliver the verdict at the end of the trial, summarizing the casesโ€™ key points, and applying the law to reach a decision; and (5) Being responsible for evaluating the mock trials based on performance criteria. This includes assessing the effectiveness of arguments, the presentation of evidence, and adherence to procedural rules. Working in close coordination with the designated UNODC ROMENA team members, the consultant will support the preparatory work and the in-person delivery in person of two capacity-building mock trials in Algiers (Algeria), one mock trial in Rabat (Morocco), and one mock trial in Tunis (Tunisia). The work of the consultant will involve desk analysis and consultations with the UNODC team and national experts on the legal system, criminal code, criminal procedure code, and rules of evidence in Algeria, Morocco, and Tunisia, as well as preparation of the concept, agenda, case studies, mock trial documents and other background documents for the activity, with the support of the UNODC ROMENA team who will be in charge of moderation and delivery of the training sessions in place. Qualifications/special skillsAn advanced university degree (Masterโ€™s degree or equivalent) in law, criminology or related field is required. A first level university degree in similar fields in combination with two additional years of relevant professional experience may be accepted in lieu of the advanced university degree. - A minimum of 5 years of relevant professional experience in the fields of criminal justice, criminal law, human rights, and/or rule of law is required; - Professional experience with criminal justice systems in a common law country is required; - Experience in delivering training, including developing training materials on combatting trafficking in persons or other serious crimes is required; - Experience in prosecuting or adjudicating trafficking in persons, smuggling of migrants, or organized crime cases is desirable; - Previous work experience as a prosecutor or judicial authority in a common law system is desirable; - Experience working with trafficking in persons issues is desirable; - Experience working in Eastern/Central/North Africa is desirable; - Experience within the United Nations system or similar international organizations is desirable.
