Organizational Setting
The Royal Government of Cambodia (RGC) is committed to the sustainable management and development of fisheries resources of Cambodia for future generations and contribute to poverty reduction and food and nutrition security at the national, regional and global levels. To address these issues, the Fisheries Administration (FiA) of the Ministry of Agriculture, Forestry and Fisheries (MAFF) is implementing an EU-supported programme entitled the โCambodia Programme for Sustainable and Inclusive Growth in the Fisheries Sector (CAPFISH)โ. The capture fisheries component under the programme, CAPFISH-Capture, comprises three pillars: 1.) Fisheries conservation and management; 2.) Fisheries post-harvest and trade; and 3.) Fishing communitiesโ social and economic development. FAO has been requested to provide technical assistance to the governmentโs CAPFISH-Capture Workplan in the form of an EU funded Complementary Support Project (CSP), FAO Complementary Support to the Cambodia Programme for Sustainable and Inclusive Growth in the Fisheries Sector: Capture component (CAPFISH Capture) to support the Fisheries conservation and management pillar within the CAPFISH-Capture Fisheries Programme.ย
This project is focusing mainly on output 1 (improved compliance with fishing regulations and protected fisheries), output 3 (strengthened fisheries management frameworks), output 6 (creation of an integrated fisheries information management system), and output 7 (more effective and relevant research for fisheries management). Under Project output 3 โstrengthened fisheries management frameworks\", FAO CAPFISH Capture is providing legal advice and assistance for the revision of the new fisheries law, sub-decrees and prakas; and providing support to FiA in developing the Strategic Planning Framework (SPF), CFi Strategic Plan, and improving the coastal fisheries governance framework.
Reporting Lines
The Technical Specialist (Legal and Policy) reports directly to Fisheries Officer. Under the overall supervision of the FAO Representative in Cambodia and the Technical Advisor (Fisheries), the incumbent will work in coordination with the Project Implementation Unit (PIU) and under the technical supervision of Legal Officers and Experts of the Development Law Service of the Legal Office (LEGN) (FAO Legal team) and the direct supervision of the Technical Assistance Team (TAT) and in close collaboration with Project Team Output Leads, the Fisheries Administration (FiA) of the Royal Government of Cambodia (RGC) and its Cantonments (FiAC) ) and other Government agencies to carry out the following tasks.
Technical Focus
The Technical Specialist (Legal and Policy) will provide legal advice and assistance for the revision of the new fisheries law, sub-decrees and prakas; and providing support to FiA in developing the Strategic Planning Framework (SPF), CFi Strategic Plan, and improving the coastal fisheries governance framework.
Tasks and responsibilities
โข ย ย Work with the CAPFISH Capture team leads, FiA, and FAO Legal Team to develop and implement a workplan aligned to the FiA Budget Support annual workplan and budget (AWPB);
โข ย ย In close collaboration with FAO Legal Team and the CAPFISH Capture Output Team 3, assist FiA in the overall process towards the enactment of the new Fisheries Law;
โข ย ย In consultation with the Technical Advisor he/she will provide technical support to the government counterparts on developing and consulting on prioritized subsidiary legal frameworks for the new fisheries law (i.e. sub-decrees and prakas for marine fisheries and CFi), national policies and strategic plans, including the SPF and CFi strategic plan;
โข ย ย Support Output 3 team and other relevant consultants in adapting the Modern Fisheries Communities (MFC) concept for Fisheries and CFi/CFR and to ensure food security and safeguarding of fishing communities;
โข ย ย Support translation of Draft Fisheries Law submitted by FIA, secondary legislation, proclamations (Prakas) and Sub-Decrees, and other relevant documents to facilitate review by the FAO Legal Team and relevant Output Teams;
โข ย ย Support Technical Advisor n developing FiA capacity development strategies, plan for the new Fisheries Law, its subsidiary regulations, and awareness raising activities. This may include modules on training and C&V materials;
โข ย ย Support project and FiA monitoring and evaluation activities including the establishment of baselines, progress reporting and work planning in relation to the new Fisheries Law;
โข ย ย Support Technical Advisor for the advocacy and implementation of the FiA Policy and Strategic Framework for Gender Equality Promotion and Child Labour Elimination in the Fisheries Sector (2022-2030);ย
โข ย ย Work closely with the project Technical Advisor and gender specialist to assist FiA and relevant stakeholders on the integration of gender equality, indigenous peopleโs rights and youth, as well as child labour elimination issues into budgeted workplans;
โข ย ย In close collaboration with the Output 3 Team Lead, Technical Advisor โ Fisheries, FAO LEGN, TAT, and other relevant project staff and consultants, facilitate and support timely and effective FAO collaboration with government partners and stakeholders in meetings, consultations, and project implementation;
โข ย ย Facilitate regular meetings on laws and policies between FAO-CAPFISH project and FiA senior management team requiring intervention by DG and the Legal Team;ย
โข ย ย Prepare and communicate updates with the FAO teams on important decisions and relevant information related to laws and policies in the fisheries sector from FiA, MAFF, and relevant governmental agencies or partners;
โข ย ย Participate in the Technical Working groups (TWGFi) and support FiA in the facilitation of workshops and meetings as required;
โข ย ย Support drafting and the compilation of documentation pertaining to the projectโs exit strategy, including lessons learned;
โข ย ย Undertake travel and work related to the above TORs as agreed by the FAO Representative in Cambodia in consultation with the CAPFISH, Technical Assistance Team and FAO Legal Team as appropriate;
โข ย ย Perform other relevant duties as requested by FAO.
CANDIDATES WILL BE ASSESSED AGAINST THE FOLLOWING
Minimum Requirements ย ย
โข ย ย Advanced University Degree in International law, public policy, international relations, political science, or a related fieldย
โข ย ย At least five years of relevant experience in providing advice to national or international bodies in analysing policy and legal frameworks
โข ย ย Full proficiency/Working knowledge of English
โข ย ย National of Cambodia or resident of the country with valid work permit
