Introduction

Ghana and Nigeria are both members of the Economic Community of West African States (ECOWAS) and face similar challenges in terms of growing demand for refrigeration services, while having to limit the economic and environmental cost of the associated energy consumption and end-of-life of equipment. Energy efficient equipment needs to be couple with using low-GWP, as if unaddressed the demand will put an even greater pressure on the electricity grid, driving back-up power generation both putting economic pressure due to high energy/electricity bills for consumers. This electricity is mostly generated with fossil fuels resulting in indirect emissions. Coupling the energy efficient equipment with a transition to low GWP refrigerants will also have profound effects in reducing GHGs by mitigating direct emissions form their release through leaks or venting after their lifecycle.


The AGORA project aims to jointly protect the ozone layer, reduce direct and indirect greenhouse gas emissions from the cooling sector in Ghana and Nigeria. And, to create a market transformation engine for energy efficient and low GWP technologies.

1. Establish or strengthen policy, regulation and partnerships to ensure the success of RAC equipment replacement schemes, avoiding GHG emissions at the end of the equipment's life cycle.

2. Transform the RAC market through ambitious replacement programmes, creating a fleet of energy efficient domestic equipment using low GWP refrigerants

3. Initiate market transformation in the air conditioning sector in Africa, by promoting certain new technology developments (notably R290-based domestic air conditioning) that are still not widely used.


Under the component of establishing or strengthening policy, regulation and partnerships to ensure the success of the rebate schemes, AGORA will aim to replicate in Nigeria the efforts made by Ghana to control the import of used RAC products that may be considered waste due to their low energy efficiency. In Ghana, the project will support the implementation of the new Import Control Act, which will complement existing legislation.

For the support component on domestic refrigeration and air-conditioning rebate schemes, AGORA will aim to increase the scale and impact of the ECOFRIDGES GO programme in Ghana, following its pilot phase. The Green On-Wage (GO) initiative, on which ECOFRIDGES is based, involves financing the purchase of new energy-efficient and climate-friendly refrigerators and air conditioners by employees and encouraging the collection and recycling of old cooling appliances. AGORA will support the scaling up of ECOFRIDGES in Ghana by aiming to add a subsidy element to promote low-GWP air conditioning units (using R290), supporting circularity elements (refrigerant recovery and recovery/disposal), encouraging the capacity of technicians to service the units, and aiming for replication / South-South cooperation in ECOWAS.


In Nigeria, the objective will be to design the refrigerator and air conditioner rebate programme based on the experience of Ghana, while adopting the most appropriate approach for the programme in the country, and ensuring the most appropriate results in terms of circular economy. A pilot phase of the programme will be implemented by AGORA, with a subsidy share for the exchange of old air conditioners for R-290 air conditioners. The south-south cooperation component will promote the exchange of experiences between Ghana and Nigeria, disseminate lessons learned at the ECOWAS level and identify the potential for replication of project activities.


Objective of the Consultancy

A Legal Analysis Expert is required to conduct a comprehensive analysis of the legislative and regulatory frameworks in Nigeria regarding a formal ban on the import of second-hand Refrigeration and Air Conditioning (RAC) equipment. The purpose of this assignment is to support the analysis and recommend policy options on the introduction of a ban.
