1. Antecedentes generales
En los 煤ltimos a帽os se han presentado un crecimiento acelerado en las solicitudes de refugio, llegando a tener un incremento de m谩s del 6.000%, en este 煤ltimo a帽o ha alcanzado r茅cords nunca antes vistos en las 煤ltimas d茅cadas. Inclusive, en el 2021, Costa Rica se volvi贸 el cuarto pa铆s a nivel mundial con mayor cantidad de solicitudes de refugio.
Si bien el fen贸meno del aumento de las solicitudes ya se hab铆a venido dando desde el 2013, por la di谩spora venezolana, fue en el 2018, por la situaci贸n del vecino pa铆s de Nicaragua, se dio una explosi贸n sin precedentes en las solicitudes de asilo y la Administraci贸n no se encontraba en la capacidad de atender adecuadamente este aumento.
Actualmente las personas solicitantes de asilo nicarag眉enses (por presentar el mayor porcentaje de la poblaci贸n solicitante de asilo) deben solicitar cita para formalizar su petici贸n que puede otorgarse para dos meses despu茅s, pero tambi茅n puede llegar a plazos de hasta seis meses o m谩s, dependiendo de la demanda y la capacidad de atenci贸n de la Unidad. Adicionalmente, este incremento (se espera cerrar el 2024 con m谩s de 85 mil solicitudes nuevas) ha provocado un aumento en los plazos de resoluci贸n.
Actualmente el Estado Costarricense con apoyo y acompa帽amiento del ACNUR encuentran en el desarrollo e implementaci贸n de una estrategia para atender la mora y para la modernizaci贸n del sistema de asilo en Costa Rica, con el que se espera dar una respuesta integral a las preocupaciones de la Unidad de Refugio de la Direcci贸n General de Migraci贸n y Extranjer铆a. Por lo que expandir la coordinaci贸n entre Estado y el ACNUR es primordial.
2. Objeto y alcance de la cesi贸n
Todos los miembros del personal y personal cedido del ACNUR son responsables de desempe帽ar sus funciones tal como se reflejan en la descripci贸n de su trabajo. Lo hacen dentro de sus autoridades delegadas, de acuerdo con el marco regulatorio del ACNUR, que incluye la Carta de las Naciones Unidas, el Estatuto y Reglamento del Personal de las Naciones Unidas, las pol铆ticas e instrucciones administrativas del ACNUR, as铆 como los marcos de rendici贸n de cuentas pertinentes. Adem谩s, los miembros del personal deben desempe帽ar sus responsabilidades de manera coherente con las competencias b谩sicas, funcionales, interfuncionales y de gesti贸n y los valores fundamentales del ACNUR de profesionalismo, integridad y respeto por la diversidad.
Tareas:
- Asistir en la preparaci贸n de asesor铆a legal y redacci贸n de documentos de posici贸n y lineamientos sobre temas legales y operativos pertinentes.
- Mantenerse al tanto de las cuestiones legales nacionales y las leyes pertinentes con respecto a las personas de inter茅s y asesorar a la oficina en consecuencia.
- Contribuir a la promoci贸n de una adecuada interpretaci贸n de la ley y la doctrina, as铆 como al desarrollo de est谩ndares de protecci贸n.
- Servir de enlace e intervenir con las autoridades nacionales, regionales o locales en relaci贸n con las 谩reas de responsabilidad anteriores, seg煤n sea necesario.
- Aplicar consistentemente el derecho internacional y nacional y las pol铆ticas y est谩ndares del ACNUR.
- Colaborar en la recopilaci贸n y an谩lisis de informaci贸n legal y de protecci贸n relevante.
- Apoyar la traducci贸n de documentos legales y pol铆ticos y actuar como int茅rprete en reuniones de alto nivel con las autoridades cuando sea necesario.
- Brindar apoyo en una amplia gama de cuestiones corporativas e institucionales, incluida la interpretaci贸n y aplicaci贸n de las regulaciones, reglas, pol铆ticas y procedimientos del ACNUR dentro del contexto de la legislaci贸n local.
- Ayudar a la oficina a brindar asesoramiento legal al personal sobre diversos tipos de acuerdos contractuales.
- Apoyar al equipo de RSD en el mantenimiento y fortalecimiento de relaciones con actores gubernamentales, as铆 como no gubernamentales, con el fin de fortalecer los acuerdos celebrados con el Gobierno .
- Elaborar borradores de correspondencia de oficina sobre temas de protecci贸n.
- Supervisar/realizar sesiones informativas sobre novedades legislativas/judiciales con el fin de preparar respuestas de la oficina y/o para incluir en kits de sesiones informativas para visitantes externos.
- Apoyar la implementaci贸n de actividades con diversas instituciones y socios de la sociedad civil.
- Realizar otras tareas relacionadas seg煤n sea necesario.
3. Seguimiento y controles de progreso
La persona estar谩 basada en las oficinas de la Direcci贸n General de Migraci贸n y Extranjer铆a, Ubicadas en La Uruca, San Jos茅; cumpliendo el horario laboral correspondiente (de Lunes a Viernes de 7:00am a 3:00 pm).
El Oficial de Protecci贸n de ACNUR, (persona a cargo del puesto), solicitar谩 la presentaci贸n de avances mensuales de los progresos alcanzados en sus labores.

Experiencia laboral
Para un LICA-7: se requiere 4 a帽os de experiencia relevante con el Diploma de Escuela Secundaria; o 2 a帽os de experiencia laboral relevante con Bachiller Universitario o equivalente.
B谩sica: Experiencia en el trato con autoridades y en un entorno multicultural.
Deseable: Buen conocimiento del mandato de protecci贸n del ACNUR. Se valorar谩 experiencia laboral en cuestiones de derechos humanos y/o derecho de refugiados.
Requerimientos de idioma:
Se espera que la persona seleccionada tenga un dominio del idioma castellano y un nivel intermedio de ingl茅s.

Senior Legal Associate
Organizational Setting and Work Relationships
The Senior Legal Associate is a member of the protection /legal team and normally reports to a higher grade professional staff.
The Senior Legal Associate assists an office in providing quality, timely and effective protection responses to the needs of populations of concern. He is also required to assist an office in ensuring that persons of concern are involved with the office in making decisions that affect them, whether in accessing their rights or in identifying appropriate solutions to their problems. To achieve this, the incumbent will need to build and maintain effective interfaces with communities of concern and authorities as well as protection and assistance partners.
The incumbent may supervise interns, volunteers and interpreters, and may also supervise some support staff. S/he assists the protection team, in making sure that protection standards, operational procedures and practices in protection delivery are in line with the international standards, and provides functional protection support and advice to other protection colleagues and other units.
S/he contributes to implementing, and adjusting when necessary, the office's comprehensive protection strategy including the role of UNHCR in the context of further strengthening the national capacity of relevant actors, both governmental e.g. Ministry of Justice, and non-governmental, e.g. NGOs and lawyers. In this regard, s/he represents the office externally on protection doctrine and policy as needed and under the guidance by the supervisor.
S/he also works independently in constantly monitoring relevant legal and political developments, in both asylum and statelessness issues, and provides recommendations to the protection team on appropriate advocacy and interventions for the office to make.
The incumbent will be conducting researches and following the judicial developments at the national and regional level. S/he will be supporting the preparation of legal materials that are shared with the national counterparts as recommendations. S/he will be engaged in preparing compilation of good practices and comparative charts on a broad spectrum of topics and reporting of the developments. The incumbent will also support organizing capacity-building activities through preparation of materials and presenting the topics.

Duties
- Assist in the preparation of legal advice and drafting of position papers and guidelines on pertinent legal and operational issues.
- Stay abreast of the domestic legal issues and pertinent laws regarding persons of concern and advise the office accordingly.
- Contribute to advocacy towards proper interpretation of law and doctrine as well as in the development of standards of protection.
- Liaise with the Legal Affairs Service on issues related to immunities of UNHCR personnel and provide corresponding guidance and support locally to concerned staff.
- Liaise and intervene with national, regional or local authorities in relation to the above areas of responsibility, as required.
- Assist in the organization of training sessions for legal professionals and asylum case workers and judges in the field of asylum.
- Consistently apply international and national law and UNHCR policies and standards.
- Assist the office in providing legal counselling to persons of concern.
- Assist in the collection and analysis of relevant legal and protection information.
- Provide assistance in UNHCR's legal publications, in dissemination of legal information on refugee law, in UNHCR's legal website and other legal advice as needed.
- Support translation of legal and policy documents and act as interpreter at high level meetings with the authorities when needed.
- Provide advice and support the office reviewing their contracts.
- Provide support on a wide range of corporate and institutional issues, including on the interpretation and application of UNHCR regulations, rules, policies and procedures within the local legislation context.
- Assist the office in providing legal counselling to personnel on various types of contractual arrangements.
- In close cooperation with the Protection team, assist UNHCR's drafting of law commentaries to draft national legislation related to refugee law, in compliance with UNHCR's positions and Guidelines.
- Support the Protection team in maintaining and strengthening relations with governmental, as well as non-governmental, actors in order to strengthen a network for assisting refugees and asylum seekers and also in strategically approach both national and local political figures.
- Prepare drafts for office correspondence concerning protection issues.
- Monitor/make briefing on legislative/judicial developments for the purpose of preparing office responses and/or to feed into briefing kits for external visitors.
- Support the implementation of activities with various institutions and civil society partners.
- Support the identification and management of risks and seek to seize opportunities impacting objectives in the area of responsibility. Ensure decision making in risk based in the functional area of work. Raise risks, issues and concerns to a supervisor or to relevant functional colleague(s).
- Perform other related duties as required.
