Result of ServiceUnder the direct supervision by Regional Coordinator Environmental Law and Governance UNEP Asia and the Pacific Office, the consultant is required to; 1. Final work plan in English. 2(a). Draft report in English reviewing and compiling relevant provisions on community protected areas of the 2023 Code on Environment and Natural Resources, related legal and policy instruments, as well as good legislative practices; as well as including an assessment of the necessity of a Regulatory Impact Assessment (RIA) for the draft Sub-decree. 2(b). Final report in English incorporating comments from the Ministry of Environment of Cambodia. If the assessment in 2(a) confirms the need for an RIA, the report will also include, as an annex, the completed RIA in Khmer, in the prescribed format, incorporating guidance from relevant governmental agencies. 2(c). Annotated outline in Khmer & English for the Sub-Decree on the establishment and management of community protected areas in accordance with Article 371, paragraph 8, outlining the potential scope, nature, directions, and content of the instrument. 2(d). Drawing on the analysis and input received on the annotated outline, a draft Sub-Decree on the establishment and management of community protected areas in accordance with Article 371, paragraph 8, in Khmer & English. 3(a). Slide deck in Khmer & English introducing the process of development and draft Sub-Decree, including the scope and proposed draft provisions. 3(b). List of actors and stakeholders to be consulted (prepared in consultation with Ministry of Environment), preparation and facilitation of consultation(s) with stakeholders as appropriate. 3(c). Work LocationHome - Based Expected duration14 months Duties and ResponsibilitiesThe United Nations Environment Programme (UNEP) is the leading global environmental authority that sets the global environmental agenda, promotes coherent implementation of the environmental dimension of sustainable development within the United Nations system and serves as an authoritative advocate for the global environment. UNEP is the United Nations systemโ€™s lead entity for addressing environmental issues at the global and regional level. UNEPโ€™s Law Division works with countries around the world to develop, implement and promote legal and institutional frameworks for environmental management and sustainable development. Its strategic direction in this respect comes from the Fifth Programme for the Development and Periodic Review of Environmental Law (Montevideo Programme V) adopted by the United Nations Environment Assembly under resolution 4/20 in March 2019, as an intergovernmental programme designed to promote the development and implementation of environmental rule of law, strengthen the related capacity in countries, and contribute to the environmental dimension of the 2030 Agenda. UNEPโ€™s Asia and the Pacific Office works in close partnership with the Law Division and key stakeholders including governments, private sector, civil society, and other UN entities to geographically serve 41 countries within the region in promoting and implementing sustainable development solutions. Implementation of environmental commitments under international law and achieving the Sustainable Development Goals in this dynamic and diverse region requires good national laws and strong institutions that adequately enforce them. UNEP supports countries in Asia and the Pacific to achieve this goal. Legal and institutional frameworks are key mechanisms for environmental management at the national and regional levels. They provide the structure to set standards to manage and regulate the environment and mandate various environmental institutions to implement these standards, and to monitor and achieve environmental compliance. In this regard, the Government of Kingdom of Cambodia has sought support for the drafting of a regulation under the recently adopted Environment and Natural Resources Code. UNEPโ€™s Law Division and Asia and the Pacific Office are supporting Cambodia in the outsourcing of an environmental law expert to assist in the preparation of a draft regulation. The general purpose of this consultancy is to support the development of a draft regulation under the 2023 Code on Environment and Natural Resources. Qualifications/special skills- Advanced university degree (Masterโ€™s degree or equivalent) in Law is required. - An advanced university degree (Masterโ€™s degree or equivalent) in Environmental Law is considered an asset. - A first-level (undergraduate) degree in Law, with 2 additional years of qualifying experience in may be considered in lieu of an advanced university degree. A minimum of five years of progressive experience in environmental law, biodiversity and sustainable development-related matters is required. Experience in legal drafting and development of legal frameworks, including on protected areas, will be an asset. Experience in working on environmental issues within Asia and the Pacific region, particularly in Cambodia, will be an asset. LanguagesFluency in oral and written English is required.
